Permitted Uses

  • A user may submit content only if the user has the right to do so because the user is the author of the content or otherwise has the right to share it.
  • SAF grants you a limited, revocable, non-exclusive, and nontransferable license to access and use this website solely for your personal non-commercial use.

Interactions with Other Users

  • You are solely responsible for, and shall exercise caution, discretion, common sense and judgment in, using the website and disclosing personal information to other website users.

Prohibited Uses

  • You shall not use the website in any manner that is not expressly permitted by this Terms of Use or other SAF rules regarding acceptable use.
  • For member-only, password-protected sections of the website, you shall not share your password with others or allow your password to be used to circumvent the need for others to become users in their own name.  You are responsible for maintaining the confidentiality of your password.
  • You shall comply with all laws applicable to use of this website.
  • You shall not use the website to distribute any content that is illegal, infringing of intellectual property rights, defamatory, harassing, fraudulent, obscene, or is otherwise objectionable as determined by SAF.
  • You shall not interfere with the use of this website by other users.
  • You shall not interfere with the functionality and security of this website.  This includes but is not limited to:  (a) no accessing the website without authorization, (b) no attempting to test the vulnerability of the website, (c) no attempting to interfere with the website such as by submitting a virus, overloading the website, modifying its code, or similar activity, and (d) no sending unsolicited commercial email or “spamming”.

 

Termination for Noncompliance

SAF may terminate use of the website by any user who violates this Terms of Use.  In addition, you may be subject to disciplinary action in accordance with the SAF Standards of Professional Practice.  A violation of the Standards of Professional Practice may result in denial of eligibility, revocation or suspension of certification, or refusal to renew certification.

Restrictions

SAF does not pre-screen or approve content.  However, SAF reserves the right to discontinue the website or to remove or refuse to distribute any content that violates this Terms of Use. 

SAF reserves the right to suspend service, with or without advance notice to users, to perform maintenance or other work to protect SAF’s property and the functionality of the website for all users.

Ownership

The website is owned by SAF and is protected by U.S. and international intellectual property laws.  The Society of American Foresters name, the SAF acronym, Certified Forester® name, Candidate Certified Forester® name, the CF® and CCF® acronym, and logos are trademarks of SAF and are registered in the U.S.  This Terms of Use does not grant you any right or license to use any SAF trademark, trade name, service mark, or logo. 
The names and logos displayed in this website are the exclusive intellectual property of their respective owners.  All material is owned by or licensed to SAF, and shall remain the exclusive property of its respective owners.

No Warranty

Each user uses this website at her/his own risk.  The materials in this website are provided “as is”.  SAF makes no representations or warranties, express or implied, with respect to this website and specifically disclaims all warranties to the fullest extent permitted by law (including, but not limited to, merchantability or fitness for a particular purpose).

Limitation of Liability

In no event will SAF be liable for consequential or punitive damages arising out of the use of, the inability to use, or denial of access to this website, regardless of whether any such claim is based in contract, tort, strict liability, or any other legal theory.

User’s Liability for Misuse

You shall reimburse SAF for all losses, damages, and/or expenses (including court costs and reasonable attorney’s fees) that SAF incurs due to any violation by you of this Terms of Use.

The website contains links to websites not operated by SAF.  These links are provided for your reference and convenience only.  A link does not imply or mean that SAF endorses the content on that website or the operator or operations of that other site, and SAF is not responsible for the content or operation of third party websites.

SAF makes no representation or warranty that this website may be lawfully accessed, transmitted, viewed, downloaded, or otherwise used outside of the United States.  Any user accessing this website from outside the United States does so at her/his own risk and is solely responsible for compliance with the laws of the jurisdiction from which access is made.

Amendment

No amendment of this Terms of Use will be effective unless it is in writing and agreed to by SAF.  SAF may change these terms and conditions from time to time by giving users advance notice of the changes and posting an updated version on this page.  By continuing to use this site following notice of the changes, you accept and agree to the terms and conditions as changed.
 

General

Any notice that either party is required or may desire to serve upon the other party must be in writing.  These Terms is deemed to have been entered into in the District of Columbia and is governed exclusively by laws of the District of Columbia, without reference to its choice of law doctrine.  The sole jurisdiction and venue for any litigation arising from these Terms is the appropriate federal or District court located in the District of Columbia.  The parties hereby waive trial by jury in any action arising out of these Terms.  These Terms contains the entire agreement of the parties and supersedes any prior written or oral agreements between the user and SAF regarding the website.  No waiver by SAF will be effective unless it is in writing and signed by SAF.  If SAF excuses the user’s failure to perform a term of these Terms in one instance, then that waiver does not excuse any subsequent non-performance of the same term.  If any provision of these Terms is held to be invalid, the remaining provisions of these Terms are not to be affected and will continue in effect.  The invalid provision is to be deemed modified to the least degree necessary to remedy the invalidity.  The obligations and rights of the parties which by their nature would continue beyond the termination of these Terms will survive beyond the termination of these Terms and remain in full force and effect.
